HB Pools Inc. Service Agreement

Service Agreement

1) POOL CLOSING WARNING:
DO NOT TURN OFF THE FILTRATION SYSTEM BEFORE HB POOLS INC. HAS PERFORMED THE WINTERIZING SERVICES REQUIRED TO PROTECT THE EQUIPMENT AGAINST FROST AND TO HELP KEEP THE WATER CLEAR. WATER MUST CONTINUE TO CIRCULATE THROUGH THE POOL HEATER AT ALL TIMES UNTIL HB POOLS INC. HAS COMPLETED THE WINTERIZING SERVICE. WARRANTY WILL NOT APPLY IF THESE CONDITIONS ARE NOT UPHELD.

HB Pools Inc. will schedule work orders during the winterizing season from September to the first week of November, and during the opening season from April 15 to May 1.

A surcharge of $100.00 will apply to all winterizing work orders requested or received after November 10. HB Pools Inc. is not responsible for any pool damage or deterioration due to late winterizing or opening.

HB Pools Inc. will remove water from the pool lines and equipment during the pool closing procedure.

2) Service charges do not include:

  • The cost of parts that need to be replaced, except those under warranty.
  • The cost of removing a pump, diving board base, or slide.
  • The cost of pumping out any excess water following winterizing.
  • The cost of cleaning the pool.

2A) Fuel Surcharge:
HB Pools Inc. reserves the right to apply a temporary fuel surcharge if fuel or transportation costs increase unexpectedly due to events beyond its reasonable control, including but not limited to war, armed conflict, political unrest, sanctions, government action, refinery interruption, transportation disruption, supply shortages, or other extraordinary market conditions. HB Pools Inc. will make reasonable efforts to charge only its actual additional fuel cost, without markup or profit. Any such surcharge will be disclosed to the customer as soon as reasonably possible and, where required by law, must be approved by the customer before being charged.

3) HB Pools Inc. will store equipment removed during winterizing in an area designated by the customer or in another safe location for the customer to retrieve at their convenience. Under no circumstances shall HB Pools Inc. be held liable for any damage incurred while moving or storing this equipment.

4) HB Pools Inc. is not responsible for any damage resulting from:

  • Water leakage arising from perforation of the liner, including slow leaks. If a slow leak is present during the winter and the pool water freezes, the ice may no longer be properly supported by the water level. This can cause the ice to shift, drop, or place pressure on the pool structure, liner, return fittings, return flanges, plugs, and plumbing lines. In such circumstances, damage may occur to the pool structure, liner, return flange, return fitting, plug, or line, including pulling out plugs, breaking return flanges, or tearing lines. HB Pools Inc. is not responsible for such damage.
  • Water that could accumulate between the liner and the wall due to underground water pressure.
  • Freezing that could cause breakage to the coping and concrete.

HB Pools Inc. is not responsible for any parts that may break during the service, closing, or opening procedure due to normal wear and tear, aging, or similar causes.

HB Pools Inc. is not responsible for any damaged equipment, concrete, or pool due to unusual weather conditions, including freezing rain, rain, sudden freezing, ground frost, heavy wind, or similar conditions.

5) HB Pools Inc. is not responsible for any damage to the pool, pool structure, step jets, fiberglass or polymer steps, concrete deck, equipment, liner, or beauty strip caused by ground movement due to frost, heavy snow, or ice loads.

6) When rainfall occurs after the pool is closed, the owner is responsible for maintaining the water at the correct winterizing level
(mid-skimmer or 2 inches below the coping when winterizing with Duck Plugs).

If the client requests further services to maintain the water level following the winterization of the pool, an additional service fee will be applied.

7) HB Pools Inc. does not remove winter cover tarps. However, HB Pools Inc. does remove safety covers.

8) HB Pools Inc. will not discharge saltwater from the pool to the street due to applicable municipal by-law restrictions.

9) Salt System: HB Pools Inc. will not test the salt system if the water is unbalanced or too cold.

10) HB Pools Inc. does not winterize gunite/concrete in-ground pools.

11) Pool and spa winterization is a procedure that requires expertise, and this procedure can have a significant impact on your plumbing system. When HB Pools Inc. winterizes your pool or spillover spa for the first time, HB Pools Inc. cannot be held liable for previous closing or opening procedures.

12) The technician reserves the right to cancel the work order if the pool, liner, or equipment is in poor condition.

13) HB Pools Inc. cannot guarantee the appearance of the pool liner or steps following pool winterizing or opening.

14) HB Pools Inc. does not offer warranties on fiberglass or polymer steps.

15) HB Pools Inc. does not offer warranties on fiberglass step jets.

16) Before winterizing, opening, or general service can be performed, the customer must have all required parts and equipment available for the technician. The customer must also remove all debris from the pool and give the technicians full access to the pool and pool area.

17) HB Pools Inc. Return Policy

  • All returned merchandise is subject to a 15% restocking fee.
  • Since HB Pools Inc. does not have a storefront, we regrettably cannot offer customers pickup of merchandise from our location in Cumberland.
  • HB Pools Inc. can deliver parts or equipment. A delivery fee applies.
  • The equipment or part must be in its original packaging.
  • Delivery fees: Orleans $25.00 – West End $45.00 – Prescott-Russell $65.00. Delivery fees may vary depending on the size of the equipment or part.
  • All goods will be inspected before being refunded.

Nothing in this Service Agreement limits any rights that cannot legally be excluded under applicable law.
